US Judge Orders Release of Abrego Garcia from Immigration Custody

A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment is without legal authority.

"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The case originates in a mistaken deportation to El Salvador in March, which US authorities later admitted was an mistake. After his return to the United States to answer human smuggling allegations, he was held in immigration custody.

In her order, the court noted that the government lacks a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."

Context of the Legal Challenge

The legal challenge center on disputed claims. While the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.

He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing trial in the state of Tennessee.

The judge, who was overseeing his petition to removal in a Maryland district court, determined that he must now comply with the conditions of his release from custody in Tennessee. This decision effectively transfers his monitoring to the jurisdiction handling his criminal case.
